T I M E L I N E S Compliance Cycles: Covered buildings must comply annually starting in 2024 with emissions limits becoming increasingly stringent every five years through 2049. In 2050, all buildings will have to meet zero emissions criteria. Article 321 Prescriptive Path Deadline DECEMBER 2024 Article 321 buildings must either: a) complete required list of prescriptive energy conservation measures; or b) meet their 2030 carbon limit in 2024. First Compliance Reports due MAY 2025 Due by May 1st each year, the reports will detail a buildings emissions in the prior year and whether the laws requirements were met. NYCHA Housing 40% Target NYCHA must make best efforts to reduce greenhouse gas emissions by 40% below 2005 levels Rent-Regulated Compliance Begins Buildings with at least one and not more than 35% rent regulated units must begin complying with laws carbon caps. A building's annual emissions are determined by combining total energy use for each fuel type multiplied by its corresponding carbon coefficient. The carbon from electricity use by buildings will go down over time as the grid gets cleaner. Local Law 97's electricity carbon coefficient for the 2030 compliance period is about 50% cleaner than the one assigned for 2024, and aligns with New York State's ambitious mandates for renewable energy deployment.
